Herkules sp. z o.o. links great importance with the protection of your personal data and other information that we obtain in connection with our websites being used. Your data is collected, processed and used exclusively in accordance with the following rules and in compliance with applicable law, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation — hereinafter «GDPR» or in Polish RODO).
This document contains the information on the data we have been collecting via our internet website www.herkules.eu.com („website”), on the way we process and use them. We also describe the technical and organizational means which we undertake to protect your data.

B Personal data
Personal data mean any information on an identified or identifiable natural person; an identifiable natural person is a person who can be identified, directly or indirectly, in particular pursuant to an identifier such as name and surname, identification number, location data, online identifier or one or more specific factors which identity physical, physiological, genetic, mental, economic, cultural or social identity of a natural person.
C Scope of personal data collected and their use
C.I. Visits to the website
It is not necessary to provide any personal data when visiting our website. We only collect and process data that your web browser automatically sends to us. They include:
- Date and time you have visited our website,
- Your browser type,
- Your browser settings and
- The IP address from which you have connected to our website.
An IP address is a number assigned to a visitor’s computer by the internet service provider. The IP number allows access to the Internet. In most cases, it is assigned to the computer dynamically, i.e. it changes every time you connect to the Internet, and for this reason, it is commonly treated as a non-personal identification data. Assigning this data to an individual natural person is very difficult. However, in compliance with the GDPR provisions, it is considered a kind of personal data.
We use the data provided by browsers to ensure the technical possibility of visiting our website, furthermore, we use them for statistical purposes and to improve the way our website works and looks.
The legal basis for the processing of the data described above is the legitimate interest of the data controller, based on art. 6 letter f) of Polish GDPR — RODO, so as to improve the functionality of our websites.
C.II. Cookies
On our website, we use so-called «cookies». These are small text files that your web browser places and stores on your computer. Their purpose is to optimize our online presence along with our offer.
Most of them are so-called «session cookies»: after the session of a given browser is finished or the computer is turned off, the information saved is deleted from the computer memory. The session cookies mechanism does not allow for downloading any personal data or any confidential information from the Customers’ computers.
Some cookies generate information that allows us to recognize automatically the visitors to our website. This is possible because cookies contain your IP address. The information gained in this manner allows us to optimize our offer and facilitate your access to our website. So-called «Permanent cookies» are stored in the memory of your hardware and remain there until they are deleted or expire. The mechanism of permanent cookies does not allow for downloading any personal data or any confidential information from the Customer’s computer, either.
In your browsers, you have the option to limit or disable the access of cookies to computers. If you use this option, our website will be still available for your use, but the availability of website functionalities may be limited.
Borlabs Cookie
Our website takes advantage of a tool which allows to manage the storing of cookies, supplied by Borlabs GmbH, with its seat at: Rübenkamp 32, 22305 Hamburg, Germany (Borlabs). While you are visiting our website, an additional cookie file is saved on your computer, memorizing the settings declared and consents granted or withdrawn with regard to cookies. This can be removed on the same principles as any other cookie files. The data gathered with its help are not made available to Borlands. The legal provisions, imposing the duty to be granted the right to use cookies (art. 6 subpara. 1 letter c of RODO in conjunction with art. 173 of the Telecommunications Law) are the ground for us to use the information contained in the declared settings related to cookies.

Google Fonts
Our website has been using Google Fonts, which are provided by Google, whose purpose is to ensure uniform use of fonts displayed on the website. Google Fonts are installed locally on our servers, so no data is transferred to Google servers when you connect to the website. More information about Google Fonts can be found at:

Google Maps
Our website has been using Google Maps, which are provided by Google Ireland Limited, with its seat at Gordon House, Barrow Street, Dublin 4, Ireland (hereinafter: “Google”). To facilitate the use of this service, you need to store the IP address. This Information is transferred to Google servers in the USA, where it is archived. As the of the website, we have no influence on these data being transferred. The data transfer by Google to the USA is based on Standard Agreement Clauses adopted by the European Commission. We have been using Google Maps to improve the appearance of our website and to make it easier to find our location. This is our legitimate interest based on art. 6 letter f) of GDPR. In the case of consent to use this technology, the basis is the consent given (Article 6(1)(a) of the GDPR), this consent may be withdrawn at any time, and its withdrawal does not affect the lawfulness of the processing carried out before its withdrawal. The data will be processed for the time in which they are necessary to achieve the purpose for which they have been collected, but no longer than until the consent is withdrawn.
C.IV. How to contact the controller
If you send an inquiry via the e-mail address indicated on the Controller’s website, we collect the following personal data:
- e-mail address of the person sending the inquiry,
- the content of the inquiry related to the above data, including its subject, and any other data provided by the person sending the inquiry.
These data are processed in order to answer the inquiry. The grounds for data processing for this purpose are the legitimate interest of the Controller, consisting in the right to establish contact and correspond with entities interested in its services and products. Personal data related to the inquiry are processed by us for the period necessary to make contact or answer the inquiry.
D Data recipients
The data collected via the website by Herkules may be made available to Herkules’ employees and to entities that process data at the request of Herkules. They include e.g. providers of hosting services or entities providing systems to analyse the traffic on the website. Herkules does not transfer to states outside the European Economic Area the data which allow to identify the users.
E Profiling
Personal data of those who use the website or get in contact with Herkules are not subject to profiling.
F Rights of data subjects
Users of the Website have the right to access their personal data and to request having incorrect data rectified. In the event the correctness of the processed data has been questioned, the User may demand that their processing be limited — for a period allowing to verify the correctness of these data.
When the data are no longer needed for the purposes for which they have been collected or processed, as well as in the event of withdrawal of consent to their processing, the User may request their removal or limitation of their processing (if they are needed by the User to establish, pursue or defend claims). If the data are processed on the basis of the Controller’s legitimate interest, users have the right to object to their data being processed. In this case, the Controller is no longer allowed to process these personal data, unless they demonstrate the existence of valid legally justified grounds for processing, overriding the interests, rights and freedoms of users, or grounds for establishing, investigating or defending claims. If it is found out that the processing is unlawful, the user may request the processing of personal data be restricted or removed.
Users have the right to get the data that have been provided to us in a structured, commonly used, machine-readable format. These data can be provided by the user to any Controller of their choice. They may also, if technically feasible, request that they be sent directly to another controller.
